Agreeing to these terms
These Terms and Conditions apply when you use this website or hire M&K South Bend Concrete & Masonry for concrete or masonry work. By browsing the site, calling us at (574) 213-0235, sending a request through our contact page or accepting an estimate, you agree to them. If you don't agree, please don't use the site or book work with us.
In these terms, "we," "us" and "our" mean M&K South Bend Concrete & Masonry. "You" means the person using the site or the property owner asking us for work.
The services we offer
We're a masonry contractor in South Bend, IN, and we also do concrete work for homes in South Bend and the cities around it. Our work includes foundation and chimney repair, tuckpointing, brick repair, retaining walls, pavers, walkways, stone veneer, fireplaces and outdoor kitchen masonry, along with the other services listed on our home page. You can read more about who we are on our about page.
The service descriptions on this site are general information about the trade. Your written estimate or contract sets the exact scope of your job, the materials and what is and isn't included. If that document differs from anything on this site, the document controls.
Estimates and pricing
Estimates are free, given on site, and come with no obligation. We price the job after we've seen it because the cost depends on the size of the work, access to it, the condition of what's already there and the materials you choose.
An estimate is our best figure for the work it describes. It stays good for the period written on it. If no period is written, we may update it when material costs change before you accept. General cost information on this site is not a quote or an offer.
Some conditions only show up once the job is open, such as water damage behind a wall, failed footings or crumbling brick under a surface layer. If we find something like that, we'll stop, show you what we found and get your approval before doing added work or charging for it.
Scheduling, access and cancellation
We put your job on the schedule once you accept the estimate. Start dates are estimates, and they can move for weather because mortar and concrete need the right temperature and dry conditions to cure properly. Material deliveries, permit timing and delays on earlier jobs can move them too. If your date changes, we'll let you know.
Please give our crew reasonable access to the work area, move vehicles and belongings out of the way, and tell us about sprinkler lines, buried cables, drainage problems or anything else you know of that could affect the work.
If you need to cancel or reschedule, tell us as soon as you can by phone or through our contact page. If we've already ordered special materials or started work, you're responsible for those materials and the work done up to the cancellation, as your contract explains. Any cancellation rights you have under state law still apply.
Payment terms
Your estimate or contract states any deposit, which payment methods we accept, and when the balance is due. Larger jobs may be billed in stages as the work moves along.
Please pay invoices by the date shown. If a payment is late, we may pause work until the account is current, and where the law allows, you may owe reasonable costs of collecting the balance.
Our workmanship and what warranties cover
We're fully licensed and insured, and we stand behind our work. If something doesn't look right after we finish, call us and we'll come take a look. Your contract spells out any written warranty on your job, including what it covers and for how long. Warranties from material makers pass to you as the maker offers them.
Some things aren't defects. Concrete can get small hairline cracks as it cures and as the ground moves. New brick, stone and mortar usually won't match older material exactly in color or texture at first, and they weather in over time. We also don't control damage from freeze-thaw cycles, poor drainage, tree roots, settling soil, de-icing salt or work done by others after we leave.
Apart from any written warranty in your contract, this website and its content are provided "as is," without warranties of any kind, express or implied, to the extent the law allows.
Limits on our liability
To the extent the law allows, M&K South Bend Concrete & Masonry is not liable for indirect, incidental, special or consequential damages, such as lost use of your property or lost income, arising from your use of this website or from our work. Our total liability for any claim about a job is limited to the amount you paid us for that job.
We aren't responsible for the content of outside websites we link to. We also aren't responsible for decisions you make based only on general information on this site, because every house is different and the right repair depends on what we find on site.
Resolving a disagreement
If you have a problem with our work or a bill, please call us first at (574) 213-0235. Most issues get settled by looking at the work together, and we'll try in good faith to make it right.
If we can't settle it that way, either of us may bring a claim in a court with jurisdiction in South Bend, Indiana, unless your contract sets out a different process.
Which state's law applies
These terms are governed by the laws of the State of Indiana, without regard to conflict of law rules. That holds for jobs we do outside Indiana too, except where the law of the state where the work is done says otherwise, such as its local building and permit rules.

Changes to these terms
We may update these terms from time to time. Changes take effect when we post them on this page, and they don't change the terms of a contract you've already signed with us.
